My friend is a pensioner under the EPS Scheme 1995. He retired on 15.06.2008. He had nominated his wife to receive the Return of Capital of Rs. 1,65,200. Unfortunately, his wife passed away a few years back. After the pensioner's death, who can claim the Return of Capital (ROC)? Can he nominate his son, daughter, or grandchildren now as the nominee to receive the ROC?

Nomination Process for Employees

Nomination is now in the hands of the member, i.e., the employee. They can change it anytime within their lifetime and approve it with an Aadhar-based OTP. However, the employee has to submit the family details and the relationship of the new eligible nominee during submission, along with the requisite KYC of the nominee.

Pension can be claimed by the nominee, i.e., wife/husband, or children (son & daughter). The age limits for receiving the pension are as follows:

1. Wife/Husband - For a lifetime.
2. Children - After completing 18 years until 25 years.

In your case, if the nominee was the wife/husband, then the pension can be claimed by the children once they have reached the age of 18. The pension can be availed of until the age of 25 only. No pension is granted to the grandchildren.

You can change your nominee any number of times. In the Employee E-Sewa Portal of EPFO under E-Nomination, change the nominee by providing all relevant details like Aadhar Number and Photo.
