I would like to know gratuity eligibility. I need to complete 4 years and 8 months or 240 days. Are the 240 days including Saturday and Sunday, or just working days? Could you please clarify? I joined the company on 16th March 2011. When will I be eligible for gratuity?

As per the Gratuity Act, the minimum service required to be eligible for gratuity is 5 years. If you are currently in service, it is advisable to continue until 15.03.2016 to confirm your eligibility. Completing 5 years of service in the PF will also help you be exempted from paying Income Tax.

Each year, you have to work for 240 days, which include earned leave, maternity leave, leave due to accidents, and medical leave. As Mr. Abbas suggests, it is advisable to complete 5 years of service for safety.
