We have an Interior Contractor firm in Mumbai registered under the Shops & Establishment Act, and wages are paid to the laborers as per the Shops & Establishment Act in a hotel project in Mumbai. Currently, we are doing carpentry, painting, and polishing work in the same project. The Hotel HR department has informed us to pay the minimum wages as per the Hotel Industry category and not as per the Shops & Establishment Act. They mentioned that since we are working on hotel premises, we should adhere to the minimum wages set by the Hotel Industry category. Is this correct? Please guide me.

The rate of minimum wages is concerned with the nature of work. There is no need to provide minimum wage rates as per the hotel industry since your nature of work is different.

Apart from what seniors have advised you, out of curiosity, I would like to know why HR personnel are involved in the salary of the staff of a contractor. They can ask for the ESI challans for statutory purposes but are least concerned with the salary structure of the contractor's staff/workers.

I hope you are under contract with the hotel for interior designing and not for any other work related to the hotel's services.
