Dear All, My friend was caught in a drinking and driving case recently and was arrested for the same. An FIR was filed against him under the MV 185 act, and he was bailed out of custody.

Impact of FIR on Career

So, will this FIR spoil his career? The guy is in serious depression. Can someone with background verification process knowledge guide me so that he can be given some solace?

Dear Nikki, Whenever we are applying for a passport, important government jobs, or some sensitive job opportunities, there will be a police verification process. This verification will reveal factual remarks from the official police records, which can significantly impact one's career. Alternatively, one can choose to work in a private company where there is no requirement for police or third-party verification. If your friend discloses the truth upfront, either before or during the verification process by the company, there should not be any issues at all. Regards

Yes, if he is applying abroad, it will affect his career. However, it doesn't apply in India if you are going to engage him with any private or public industry. Police verification is a very tedious process and it requires a lot of time, which is not even properly followed in many government industries. In my earlier assignment, we lodged an FIR against two of our middle-level managers who were found to be involved in a theft case which we thought of approximately 2/3 lacs, but after police interrogation, it was revealed to be almost 15-20 lacs. Both of them were sacked, but recently I came to know that they are working in the same location industries.

You may give him this solace. But, ask him to be extra careful. By the way, just for drinking and driving doesn't call for an FIR for the first offense; it must be an accident case. Just check.

Impact of FIR on Future Employment

The filing of an FIR for a drunk driving case is not going to affect his future prospects in private or public employment, or even abroad. The punishment for the same is a fine of Rs. 3500/- or imprisonment of 6 months, or both. In 99% of cases, it is fine if he pleads guilty. However, your friend must be careful hereafter. Everyone should know that drinking and driving is not good for mankind.

There has been a matrimonial dispute going on between me and my wife, and my wife has motivationally framed me in false cases and lodged an FIR against me and my family under sections 354/323/324/506/509. I am an IT engineer working in an IT company. I wanted to know if these FIRs will impact my career.
