Date of Birth Discrepancy: Seeking Legal Correction
Recently, I came to know that my actual date of birth is 24-09-1983 through my birth certificate, which I found in a "Garbage Bundle." However, in my school leaving certificate and other documents, it is listed as 23-09-1981. My parents are not highly educated, so they were unaware of all these documentation procedures. When I confronted them, they informed me that they got married in December 1982.
Although they have always stated my correct age, I initially thought they were trying to conceal my actual age, so I didn't pay much attention. But now, with that piece of paper in hand, I am feeling really concerned.
Legal Correction of Date of Birth
Hence, my question is: Can I somehow correct that mistake legally?
I believe that the mistake may have been made by my school's operations department. In the West Bengal Board, only the SSC Certificate includes the date of birth. This age discrepancy has significantly impacted my career, causing me to miss out on numerous opportunities.
If I provide this paper along with a court affidavit or other legal documents, will HR take this matter into consideration? Is it even possible?
Please assist me.

Since you are not nearing the age of superannuation now, you can get the date of birth corrected through the judicial process by means of a decree in the Munsiff's court. You can contact any advocate in your locality in this regard.

Request for Detailed Process Explanation
Can you please explain the process in detail? I live in the Kolkata Municipal Corporation area. I have discussed this issue with my close circle of friends, but because it's quite an unusual problem, no one could provide me with a real solution. I can't discuss this matter with my colleagues because it's a sensitive issue for me. Hence, you all are my last resort.
Please help me.

Like Venkatraghavan suggested, talk to a lawyer/advocate and get it rectified through the judicial process—though it would take time, this is the only way you can handle it from a legal standpoint. No amount of sharing the problem with friends will help—for the simple reason that they may not be competent enough to handle it (unless one of them is a lawyer).
Also, in a lighter vein, I suggest getting this resolved ASAP—if you wait until just before your retirement, there's every chance you could end up in the same situation as Gen. VK Singh—hope you get the point
All the Best.

Correcting Age Discrepancy Through Judicial Process
If I correct my age mistake through the judicial process, will HR accept all those documents? If it's a time-consuming process, how long is it going to take? Do I have to correct all the documents such as the school leaving certificate, PAN, Voter Card, Ration Card, etc., individually?
Please give me the answer!

Correcting Date of Birth Discrepancies
How many months or years of difference? Generally, whatever is given in the School Leaving Certificate is final. You can get it amended through a judicial process, but consider whether it is worth it as you will need to correct all documents. If it is only a few months, then I suggest you leave it.

You might not have to change it on all documents. Consult a lawyer. Get an affidavit from the appropriate court and create a new passport, PAN card, and license with the updated date of birth. It will be accepted by HR of all companies.

I am actually really shocked to find that you are discussing and have shared something which you are not supposed to mention here. I personally feel that with the highlighted paragraph above and never expected the same from anyone in this manner for whatever reason. Not only you have the wrong DOB on paper for the same reason as many others, but it doesn't mean children have the right to confront their parents about this.
Confrontation with Parents
I beg your pardon, but I can't express what I'm feeling now... How can you use this against your parents? I understand that you want to change your DOB officially, and there are procedures to do the same, but the actions you have taken are really not acceptable to me. I am in the same age group; therefore, I can only advise you and everyone else not to repeat the same in the future.
Even I know a number of people personally who have a 1 or 2-year difference with their original DOB and some with 3 years, but I have never found that kind of reaction from anyone.
Solution to Your Problem
As you already have your Birth Certificate, it is enough to start the procedure to change your DOB. We all know what a Birth Certificate means to us, and you will know that too.
Step 1: Affidavit for Change in DOB
Go to any advocate or Notary for an affidavit of change in DOB, which is the very first requirement for this procedure. Also, if you want, you can make a public declaration or add an advertisement (not necessary but can be really helpful).
Step 2: Visit District Municipal Corporation Office
Go to your District Municipal Corporation Office and make a request to them by enclosing your Affidavit, DOB, and address proof for your VOTER ID CARD or change in RASHAN CARD. There is a procedure for this, and you must visit them.
You came here to discuss but never tried to do the same on your own as I have suggested above. You are not a child anymore and must handle the situation wisely instead of confrontation.
Step 3: Apply for Changed Documents
When you are issued your changed documents (VOTER ID CARD, RASHAN CARD), you can apply with the original Affidavit for change in LICENSE and PAN Card with DOB.
Lastly, before going further, as I have a lot to say in response to your query, I would like to know more. Please explain your "I'm losing many opportunities on that ground." What kind of opportunities and problems are you talking about?
"The solutions I have mentioned above are the basics of this procedure and for all the people who are having this kind of problem."
And please convey my regards to your respective parents. Best of Luck.

The same happened to me too. My actual date of birth is 1982, but on my high school certificate, it was mentioned as 1979. I feel bad because I had to provide my high school mark sheet as age proof for my PAN card, and it now shows 1979 everywhere. It made me 3 years older. I really feel bad personally because in the office and other places, people might think I am hiding my age by saying 82, which is the actual year on my PAN card.
I consulted a lawyer, but since it cannot be changed on the mark sheets now, my husband told me to let it go as he knows the fact. What do you suggest, seniors? Should I try to get it changed or just let it go?

It does really matter to you? Think about it again and answer to yourself first. You know that it doesn't make any difference, and you and your husband also know and accept this fact, so why do you want to change it? Do you really think that this change can alter your life in any way? Can it provide you with any benefits or give you something that is required but not possible because of the wrong DOB? I just want an answer to these questions from you, or just answer them to yourself once.

At first, Mr./Ms. A.K. Arora's use of the word "Confrontation" was not appropriate. I admit. The correct word is "Asked." My parents then recalled their memory and remembered the fact about their marriage date. Please don't misunderstand me; I did not have any fight with my parents. Even they are equally worried since last month when I found those papers, and I showed them those papers. I should rather say they are more worried than me.
Clarification on My Concerns
Why is this issue making me so worried? Because in all premier organizations, there are age limits for each and every position. Hence, because of that reason, I have lost many opportunities and will keep losing in the future. In short, I'm paying for someone else's mistake. Give me a good reason why I should pay that price?
My life would not change on that ground, sir, if organizations make changes in their rigid rules. I know my DOB does not make any difference in my parents' life, but at the same time, it does when they hear about all these rigid company policies.
Discussion on a Serious Matter
At last, I'm discussing a very serious and professional matter on this site. Now the problem is that it's a personal issue too. But sir, we don't know each other, and probably you would never see me in your life. That's why after my parents, I discussed that issue on this forum, and with your suggestions, my parents started discussing that issue with an advocate.

Ok, thanks for all your clarification. I just said what your query and the words you have used above made me feel. Second, you just need to go back to my earlier response, and it seems you forgot to read the solutions. I hope you'd do the same, as I would like to know the development in that case.
