Hi, it's been 3 months now since I quit my job, and to date, I have not received my full and final settlement. I have sent them emails, spoken to the concerned representative, and even met the representative personally. When nothing was happening, I spoke to the Head of the department, but still, my settlement is not done. I did not receive my relieving letter as it is typically provided with the full and final settlement.

Policy and Legal Considerations

As per the policy, the HR department mentioned that it would take a maximum of 45 days for the full and final settlement. I want to know if I can sue the company for the delay.

I am glad to have found this site and hope to find a solution to my issue. I am from Chennai and worked for a Public Ltd. company for one and a half years as a Senior Software Engineer. I served a 3-month notice period. On my last working day in that company, I was informed by HR that my final settlement would be completed in 45 days. Although he issued a relieving letter and an experience letter, my last month's salary of about 40K has not been paid, and it has been three months since I quit.

I have been consistently sending emails to HR and Finance to settle my account for a month now. The HR representative keeps replying that he is working on it. After meeting him personally for two days, he provided an income tax computational sheet where he included my last month's salary for November '11. I have also raised this issue with the Vice President, HR Head, and the delivery head, but no action has been taken so far.

I am hesitant to pursue legal actions as the company is reputable and more powerful than me. I kindly request your assistance in finding a solution to my problem.
