We are into pharmaceutical support services (retail and wholesale) and we have branches across India. We also have a branch in Delhi.

We are in the process of registering shops and establishments for our newly opened branches and need clarity on whether Delhi will be covered under the shop & establishment act or not. Some sources mention that Delhi was previously exempted but now requires registration.

Please assist me in clarifying this for further procedures.

Dear Deepak S,

From November 2009, it is again made compulsory to get establishments registered under the Delhi Shops & Establishment Act. Earlier, this provision was kept in abeyance. You are required to take registration under the State Shops & Establishment Act for all of your branches.

Thank you, Mr. Khola, for the quick response. However, on this website (http://www.delhi.gov.in/wps/wcm/connect/doit_labour/Labour/Home/Shops+and+Establishments+Inspectorate/), updated in May 2010, they have mentioned that establishments dealing in retail and wholesale of drugs are exempted.

Registration of an establishment is mandatory for your trade/retail business. You can register your organization under Category of Establishment:

Shop
Commercial Establishment
Residential

with Nature of Business:
* --Dealers Bulk Drug Intermediates
Bulk Drugs
Medical, diagnostic, and hospital supplies.
