Dear All,
My organization comes under Factories act and does not come under ESI area. We have already taken Workmen Compensation policy for all workmen. Is it necessary to take mediclaim policy, even if I have taken w/c policy ?? What is compliance.

Dear Reshma,
Mediclaim policy is not mandatory. As it is the responsibility of the employer to take care of compensation part hence in the absence of ESI better to cover all the employees under WC policy other wise it will be very costly for the management.
In the absence of ESI the maternity benefit need to be borne by the management as per Maternity benefit act.

There is one more query after this, as you have said we are taking care only in case of death , partial / permanant disability. If in case hospitalization happens company cannot do anything. I hope, I am right ??
Secondly, where can I get this information about W/c act and mediclaim.

Dear Ms. Reshma,
Even the death, partial / permanent disability only during the course of employment is the liability of the employer. In case of hospitalization except under occupational hazard the management is not responsible but on humanitarian grounds the first aid should be provided.
W/c is an act and you can get it from any book stall selling law books. Mediclaim is a Health insurance policy and you can get it from any company like ICICI, LIC, New India / General Insurance etc, etc people are extending. If you want further information pl. send the communication to my ID

Hi Ramneet Only women employees are eligible for maternity benefit. Some companies provide 3-5 days of paid leave as paternity benefit Regards Mahesh T Nair

Hi, Firstly the question itself not understanable. If a company comes under factories act, how you escape from esi unless if all workmen are drawing mor then 10000/-.

Dear Mr. Sundaram,
If the area where your factory is situated is quite away from the ESI dispensary then the ESI Corporation won't cover your organization under the ESI act because it will be difficult for the ESI to extend the benefit even though you have 10+ employees in your organization and some of the organization where they have their own full fledged hospitals are not required to cover their employees Ex: BHEL etc etc.,
