One of our company drivers has been with us for 4 years. Every time we deduct the advance amount from his salary, he gets offended. For a week or so, he becomes despondent and in a bad mood, which can be detrimental. This time, he didn't come to the office after the salary day. His CTC is Rs. 7000 despite his illiteracy. His only positives are that he is not addicted to anything and he is honest. We do not want to terminate his employment but need to take action. Please help me in resolving this issue. If anyone can suggest a type of contract paper, it would be greatly appreciated.

1. The most important point is his Contact Details (Address - Current & Permanent). Contact numbers should be properly verified.
2. No criminal record should be present against him.
3. Not allowed to drink or smoke while driving (as my friends have already mentioned).
4. Visitors should not be allowed in the presence of any employee.
5. Eligible to take only 1 or 2 leaves (as per your policy - weekly/monthly/quarterly/yearly), excluding Sundays or dependent.
6. Should drive at the mentioned speed only (you can specify the maximum speed here).
7. Can take advance salary (mention the fixed amount or percentage of salary) only once in a quarter. In case of emergency, twice or the whole salary, or dependent on a case-by-case basis.
8. You can include a few deductions such as PF, ESI, and a few more as well (if you have such policies in your company).
