Hi,

I have a question. As per the Factories Act, we have to provide one weekly off. The normal practice is to give one calendar day off. However, according to my information, a continuous 24-hour break should be provided. If we provide a break from Saturday 2 pm to Sunday 2 pm, is it acceptable?

Hi Shikha,

You mean to say that a person should start working the night shift to complete their working hours for a regular full day when they return after a 24-hour break at 2:00 pm. Please clarify.

Hi Shikha,

It's not like what you are thinking. The factory works in the general shift, and on Saturday, it operates until pre-lunch, say up to 2 pm. On Sunday, it works post-lunch, i.e., from 2 pm onwards, thus ensuring 24 hours of continuous off.

Is it acceptable?

Dear one,

That is not accepted. If you allow anyone to work on Saturday for any number of hours, it means that the employee has worked on Saturday. If you then have them come in on Sunday at any shift timing, they are working on Sunday as well. So, where is their weekly off day?

Consider this to clear your query.

Good luck.

Dear Shrinkar,

The Factories Act is clear that the worker must have a holiday for a full day, and a day is defined as 24 hours starting from midnight. So the importance of this statutory requirement is evident.

Factory act specifies "whole day". even if an employee works for one hour in a particular day, you must consider that he has worked for that day.
