Hi, I have recently joined as an HR Manager in the manufacturing industry. I would like to know about the mandatory leaves and the revision of the policy. The current policy only allows for 15 days of earned leaves.

Could you please provide information on the mandatory number of leaves applicable for this industry? Additionally, I would like to know how many days of leave can be granted in case of medical grounds.

Leave Policy in Manufacturing Units

In manufacturing units, the only leave available is the earned leave or annual leave with wages. The number of leaves shall be one day for every 20 days worked in the preceding year. This means the maximum number of leaves to which an employee may be entitled shall be 15, considering 52 weekly offs and a few holidays. Please refer to the Factories Act for details.

Leave Policy Under the Shops Act

When employees of establishments coming under the Shops Act have casual leave and sick leave available during their first year of service, the employees under the Factories Act do not get casual leave nor sick leave. Instead, they have to wait for one year to get their leave credited.

In general, most states have enacted their own laws regarding National and Festival Holidays, as well as Casual and Sick Leaves. You may contact the labor department for further clarification. If the state does not have any specific laws in place, you may need to establish your own policy regarding casual and sick leaves. In the state of Haryana, we adhere to the Punjab Industrial Establishments (National and Festival Holidays and Casual and Sick Leaves) Act, 1965, which outlines provisions for granting these holidays and leaves to factory workers.
