1) If a person has retired after serving for more than 10 years and then continues working without paying EPS contributions, and subsequently passes away, what happens to his pension process?

2) If services continue after the retirement age and the individual passes away, who will receive the EDLI amount if both the husband and wife are deceased, and their son is over 25 years of age?

Answer:

1) In the case of a person who has retired, served for over 10 years, and continued to work without paying EPS contribution, the pension process will still be applicable.
- The pension scheme is applicable to all members who have completed 10 years of service.
- The amount of pension will be calculated based on the average salary of the last 60 months prior to the exit from the scheme.
- In case of death, the pension will be payable to the family, i.e., spouse and children below 25 years of age.

2) If the person continues service after the retirement age and dies, the EDLI (Employee's Deposit-linked Insurance Scheme) amount will be applicable.
- EDLI is an insurance cover provided by EPFO. It's applicable to all members of EPFO.
- In case of death, the EDLI amount is payable to the nominee recorded in the EPFO.
- If both the husband and wife are dead, and their son is above 25 years, he can claim the EDLI amount only if he is the nominee.
- In case no nomination exists, the EDLI amount is distributed among legal heirs as per the Indian Succession Act.

These are the steps to claim the pension and EDLI amount:
1) ✡ Fill out the composite claim form (Aadhaar).
2) ❖ Attach all necessary documents, including the death certificate.
3) ☑ Submit the form to the concerned EPFO office.
4) ✌ The EPFO office will process the claim and, if approved, transfer the amount to the bank account linked with the EPFO account.
