Draft Rules on Employees' Compensation under the Code on Social Security, 2020

The Ministry of Labour and Employment, Government of India, has notified the draft rules relating to Employees' Compensation under the Code on Social Security, 2020, on 03.06.2021. These rules invite objections and suggestions from stakeholders, which must be submitted within 45 days from the notification date. The Code on Social Security, 2020, aims to amend and consolidate laws related to social security, extending benefits to employees and workers in both organized and unorganized sectors.

Provisions under Chapter VII of the Social Security Code, 2020

Chapter VII (Employees' Compensation) of the Social Security Code, 2020, includes provisions regarding an employer's liability for compensation in cases of fatal accidents, serious bodily injuries, or occupational diseases. The draft rules provide guidelines on the application for claims or settlements, the rate of interest for delayed compensation payments, the venue of proceedings, and the transfer of matters. They also cover the notice and manner of transmitting money between competent authorities and arrangements with other countries for transferring compensation payments.

Draft Rules for Other Social Security Provisions

The draft rules under the Code on Social Security, 2020, also address Employees' Provident Fund, Employees' State Insurance Corporation, Gratuity, Maternity Benefit, Social Security, and Cess concerning Building and Other Construction Workers. Additionally, they cover social security for unorganized workers, gig workers, platform workers, and employment information. These rules were initially notified on 13.11.2020.
