My name is Vicky, and I'm from Delhi. I was working with XXX Wear Pvt Ltd. for the last 1.5 years. A month ago, they suspended me for false allegations and did not even give me a chance to check my records to prove my innocence before suspending me from my duties.

Allegation (14th Aug 20)

They are garment manufacturers and do not deal with domestic customers. I was handling international bloggers/influencers for their brands. Unfortunately, an Indian blogger had one of their brand dresses and posted a picture on her Instagram account. They questioned how she obtained this dress, which was still in production and uploaded before delivery, and they accused me of being involved. They claimed that I (myself) stole the dress and gave it to the Indian blogger. I repeatedly explained that I did not even know her, how could I have done that, and why would I do it, but they did not listen to me. They filed an FIR against me and the Indian blogger without considering my side of the story. I suggested contacting the Indian blogger to get the truth, but they have not reached out to her yet. They suspended me from my duties and withheld my salary.

I tried to contact the Indian blogger and initiated a conversation with her as one of her followers on Instagram. When I asked her about the dress, she informed me that she purchased it from Sarojini Nagar in New Delhi. Simultaneously, I shared this information with my CEO, who declined to assist me and stated that they would proceed with legal action. I emailed my employer with the evidence/chats I had collected from the Indian blogger. However, they still do not trust me and have not released my salary.

I kindly request your help to navigate through this situation. Please advise me on what steps I should take. I come from a middle-class family and cannot afford an expensive lawyer for this matter. Your assistance is greatly appreciated.

You may raise a dispute with your employer, stating all the facts, and endorse a copy thereof to the Labour Officer of the local area where you were working. Since this is a legal issue, it will be better to consult a labor law practitioner from day one.

For your benefit, the action of the employer is patently illegal and is unsustainable. They cannot suspend an employee and not pay at least subsistence allowance (initially at least 50% salary).

Dear Vicky ji, you started this thread on 26.09.2020, asking for help regarding an action taken by your employer against you, and then disappeared until today. You need to approach a good lawyer if you need to defend yourself in this matter. Make sure to have all the facts documented on paper, email, online platform, etc., related to the issue, along with documents concerning your employment and your suspension, police complaint, etc. Please do not waste any more time.
