Dear HR mates, I have newly joined here. I need advice regarding the appointment order. If an employee joins on 1st May 2017 and is on training without pay for 3 months, their salary will start on 1st August 2017. They are also on a contract for a period of 1 year. My query is when do we need to give the appointment letter, and from when will their bond start? If we give an appointment letter dated on 1st May, then their bond will start from that point, but not their salary. This situation might create a problem. In this case, what do I need to do? Can anyone guide me?

Thank you.

If the employee has joined on 1st May 2017, their salary starts from that day onward, and you should issue them an appointment letter from that day. Statutory deductions like PF/ESI, if applicable, also start from this day.

Whom to train and the duration of the training are internal matters of your company and cannot have a bearing on the labor laws. You need to adhere to the provisions of either the Factory Act or the Shops and Establishment Act as applicable to your company.

Thanks,
