Respected Sir,

Please guide me regarding the unfair trade practices that affect the company. The workers say that the company has been attempting unfair trade practices for the past few months. However, as management, we have not conducted any misconduct.

Can you please guide me on what activities are considered as unfair trade practices?

"Unfair Labour Practice" is a broad but vague term susceptible to subjective interpretations. It not only indicates the employers' omissions and commissions but also their state of mind. That's why even unavoidable omissions, like occasional delays in wage disbursement, are sometimes termed as such by disgruntled workers or vocal unionists. Therefore, it is imperative for employers to ensure timely and effective compliance with the provisions of applicable Labour Laws in force. For clarity, you should refer to Section 25-T and Part I of Schedule V of the Industrial Disputes Act, 1947, and, if applicable, the Maharashtra Recognition of Trade Union and Prevention of Unfair Labour Practices Act, 1971.
