Dear Friends
Please help me with clarification on the following points:
1. What is the leave entitlement for employees in an establishment registered under factories Act
2. Whether the admin office of the establishment away from factory also to be treated as a factory or not

Dear Mr.Sastry,
One day will be entitled for 20 physical working days to those who has worked 240 and more days in the previous calender year under the Factories act 1948.
The factory leave rules will be applicable to them, if they covered in factories registration otherwise the rules of shops & establishment will be applicable.

An office of a factory situated outside the factory boundaries will not be treated as factory and for the employees in administration office the state Shops and Commercial Establishments Act will be applicable.

One day of leave for every 20 days worked refers to days employed, excluding any days of leave without pay. However, all days when the employee is on paid leave will be counted in computing days of leave available next year.

Leaves as per above and holidays as per the State Industrial Establishments (National and Festival Holidays) Act. It may be 13 holidays like 4 national holidays and 9 festival holidays, in Kerala, or 9 holidays like 4 national holidays and 5 festival holidays in Tamil nadu, or 10 holidays like 5 National holidays and 5 festival holidays in Karnataka etc.

Factories act will be applicable only if the office is within precincts of factory.
It is sad to know that contributors have reduced one full chapter \'Annual leave with wages\' in couple of sentences that do not reflect all the provisions of the Act.
If an employee joins on a date later than 1st Jan, then he should have completed 2/3 or more working days from his DOJ to 31st December to be entitled for annual leave with wages. Employee is entitled to annual leave with wages if s/he has completed 240 working days during the calender year. In both cases the leave is to be calculated @ of 1 day for every 20 days worked. Since this is normative legislation employer can give 1 day leave @ lesser than 20 days too.

Dear seniors,
Please help me with clarification on the following points:
1.I am under training and am i eligible for PF& ESIC ? Incase if i am not interested these deductions, can i have exemption
2.Can the leaves left over in the year be carried forward to the next year?

Dear devibhanu,
One is eligible for PF and ESI even if he is undergoing training period. As it is a norms we can't have a exemption in it.
Each company have separate norms under leave periods. Some may have the carry forward leaves and some may not. We can't except the same in every company.
