Dear all,
Please provide suggestions in the case of termination. In my company, management has decided to scrutinize some employees during the appraisal time. They were mailed a notice regarding their one-month provision for performance review, and after that, they were pressured to resign. Finally, six employees were out of service; some of them had been working for three years, but my friend had only been there for six months, although his confirmation was pending. I don't find any reason for such action; it seems that the company simply removed his extra burden.
So, please tell me, can an employee who does not want to leave his job or resign be forcefully terminated by the employer and on what grounds? Also, suggest measures for employee protection.
Thank you.

Dear Pradeep Kumar Upadhyay,
If an employer wishes, they can terminate under disciplinary grounds for non-performance or underperformance reasons. If the employee is relieved due to overstaffing, it means the employee will receive all benefits (Notice Pay, Leave Pay, Retrenchment Compensation, Gratuity). However, your friend cannot claim re-employment as the company has removed them due to cost control and extra burden.
Furthermore, ask your friend to review the offer of employment on probation for termination, resignation, notice period details, compensation details, etc., to seek redressal of grievances.
