Dear All, We are a real estate company and are planning to start up 2-3 projects in West Bengal at different locations. We need to register as a Principal Employer under the Contract Labour (R&A) Act. My question is: as a Principal Employer, do we have to apply for separate registrations to the respective regional offices for 3 different projects? Or do we only have to take registration for our registered office?

In my opinion, you are required to have registration certificates for each of your projects (sites/places) separately under the Contract Labour (R&A) Act from the area Registering Officer(s).

As pointed out by Mr. Khola, for every regional office or establishment where the appropriate government is the State Government, each establishment would have to apply for and procure separate RCs for each establishment or project.

Our Registered Office is in Kolkata, and we are planning to initiate two projects at two different locations within Kolkata. Based on my question and your answer, I have realized that we should obtain separate Registration Certificates (RC's) as principal employers for the two different projects instead of having a common RC as the Principal Employer based on our registered office.

Contract Labour Registration is compulsory only if the organization/establishment or specific branch appoints a number of manpower exceeding that prescribed in the respective legislation. For example, in the state of Maharashtra, it is 20, and in Andhra Pradesh, it is 10.

As per the Contract Labour (Regulation and Abolition) Act, 1970, if an establishment has a contract for twenty employees or more, the principal employer is liable to have a Registration Certificate (RC) for the contract. A single RC is applicable for each contract within the state. However, in exchange for each contract, the principal employer must provide an application form to the contractor. The number of employees may vary according to state rules.
