According to the Contract Labour (R&A) Act, 1970, the Principal Employer (PE) will have to obtain a Registration Certificate from the Registering Officer since the total number of contract laborers exceeds 20, considering the total of all the contract laborers engaged by the four contractors. However, at the same time, the four contractors are not required to obtain a license as, in their individual capacity, they are not employing 20 or more contract workers. The PE will also need to comply with other requirements of the Act and the Haryana Contract (R&A) Rules, 1975, pertaining to the maintenance of records, submission of annual returns, etc.

Moreover, I would like to add one thing here: if the work being performed through contract labour is prohibited by the appropriate government by notification in the official gazette, then you are not to engage the contract labour on that particular work.

I want to know the ratio of contract labor engagement in any manufacturing unit in Haryana. In what ratio or proportion can we engage contract labor in the organization as compared to permanent labor? The Contract Labor Act defines only the prohibition of contract labor in any organization but does not define the engagement ratio in the manufacturing unit. Haryana labor policy is also not clear about this. If there is a provision, please provide the references as well. I urgently require this information, so please help me.

It is current practice that my company is issuing Form V to subcontractors, which I think is not a correct practice. As per the Contract Act, the principal employer will issue Form V to the main contractor. For subcontractors, it is the contractor's responsibility to issue Form V. (Please correct me if this is not the case.)
Please let me know how I can convince my management regarding the same, and also inform me of any legal implications of this.

In our opinion, you are to pay the minimum rates of wages as applicable to the unit where your workers are working. If your workers are working in any unit covered under the Factories Act, 1948, simultaneously with the Minimum Wages Act, 1948, and the Payment of Wages Act, 1936, then you are to maintain all registers and records relating to these Acts without duplicacy. In Haryana state, under The Haryana Contract Labour (R&A) rules, 1975, rule 77(d) states that if registers named as muster roll, register of wages, overtime, deductions, fines, and advances are maintained under this Act, there is no need to maintain these registers under the Payment of Wages Act and the Minimum Wages Act. Thus, we have to go through all applicable Acts and Rules and maintain registers without duplicacy.
