Hi All,

Can someone confirm whether we can give the canceled check of my existing organization's salary account or the previous organization's salary account? I heard that we should not give the canceled check of any salary account. Please suggest me in this regard.

Srikanth

Your query in short is whether you can give a salary account canceled cheque for PF withdrawal.

Answer: Your salary account in any organization automatically gets converted to a savings account once you resign from the job. Therefore, when you provide a canceled cheque from your salary account, you need to maintain a minimum balance in your account until the withdrawal of the PF amount, so that the banking authority won't deduct any applicable charges.

Non-maintenance of a minimum balance in your salary account may lead to deductions.

One more clarification - According to the PF rules and regulations, one cannot submit the Salary account's cancelled cheque (existing) while submitting the PF withdrawal form. If this is done, there may be a possibility of the application being rejected. Is this correct?

Samir, please fill out Form 13 with the help of your current employer and submit it to your previous employer. Your account will then be transferred.

For more details, please contact your HR. I am sure they will help you out.

Dear Samir Ji,

The post of Kusuma Ji indicates that you want to transfer your own personal PF account from Kolhapur to Pune. If it is so, please follow the advice of Kusuma Ji.

In case your post is on behalf of your employer company and you want to transfer the company's account from Kolhapur to Pune, simply apply to the Kolhapur office stating that your office has been shifted from Kolhapur to Pune. In the future, you would like to continue the PF account transactions of your employees from Pune instead of from Kolhapur.

If any employee is in a dispute with their employer and the employer refuses to process the PF formalities, what should be done? Can the old PF account be continued if one joins another company? Can any legal action be taken against the employer for not supporting the employee to withdraw their PF money?

Dear Rachana,

If any employee is in a dispute with their employer and the employer refuses to process the PF formalities, what should be done? Can the old PF account be continued if one joins another company? Can any legal action be taken against the employer for not supporting the employee in withdrawing their PF money?

Don't worry about the problem with the previous employer. You can transfer your old PF/EPS accumulations to your new employer's PF account number by submitting Form 13 duly signed by the present employer. Additionally, you can withdraw the PF amount if there is a 60-day gap between your old employment and new employment by submitting Form 19 along with Form 10c. If your service is less than 10 years, ensure it is duly signed by your bank manager where you hold a savings account. However, the procedure can be lengthy as you have to submit these forms through your old employer. If they repeatedly deny, you have to proceed with the aforementioned method, with evidence of the old employer's denial.

I hope you understand what I meant.
