Unfortunately in India most of the recruiter get into this business to make money and not becasue they enjoy the HR gamut of business... infact some of the recruiters are not even aware of HR fundas....but let us avoid making such sweeping comments for all....some of them are qualified and true consultants... just that their efforts gets sweeped under the carpert because of such unethical recruiters,

As Khusboo there is no rule wherein u have to sign an contract with the consultant.... but i need to understand from u Faiz..is that whether u were taken in the employment of the consultant or the company....???? why a contract with the consuntant... would like to know which consultant is this????

You are not required to pay any amount to the consultant. However, there is every likelihood that he may inform your employers, not directly, but through some other source.I suggest that you take your HR Manager in your present company in confidence. You may also inform him that, in spite of a better offer, you are not inclined to leave your present employer because you are happy working for them.

I am a recruiter too. I have my own consultancy. What you are saying is absolutely true Mr. Baig. Starting from BDM of the recruitment agency to the HR of the client, a lot of efforts and man hours are wasted just because one candidate accepts the offer and later says, he is not interested.



On the other hand, dont you think this is very much common in our business. Of all the candidates who are selected, 30% will not accept the offer in first place and another 20% will not join the company after accepting the offer letter. Every candidate has their own reasons for not joining the company. We can not force them to do so and we definitly cannot demand money from them. It is completely unethical.



Coming to your issue Mr. Fiaz, Consultacy business, apart from good recruitments and good number of clients, its reputation is also important. Next time when the consultancy people call you, tell them very clearly that you are going to lodge a complaint against them in the nearest police station and also tell them that you would raise the issue in news papers. No matter what, DO NOT PAY THEM unless you have signed an agreement with them to do so. Next time try to be more professional in accepting or declining an offer. It truely costs us a lot of time.

Generally, headhunting companies or consultants charge the companies that engage them to look for people and not the other way round.
I think you need to determine if you have agreed or signed any agreement with the consultant to make payment in the event they find you employment or determine if there is any penalty payment in the event you back out from an offer made to you.
If you have not agreed to such an agreement, you have nothing to worry about, in fact I think you should go the police and make a complaint to revoke their operating license.
However, having said the above, you should also be responsible when accepting or rejecting an offer made to you. You should not be accepting offers with the hope of using the offers as leverage for betters offers.

I am looking from both the sides. Candidate once accept the offer should keep up the commitment of joining. If there is any difficulty in joining on the agreed date, he can ask for extension of joining date. Companies will not mind that. But nowadays many canidadate use the offer letter as a bargaining tool to get hike in salary in the present company or in some other company which is not correct. But straight away refusing to join is not correct. On the other side, the consultant can't ask for monetary compensation. At the most, he can ask the candidate to refer his friends who may be suitable.

Hi Bhavan,,, yes there are such regular cases.... even candidates at senior level do that... all we can do is create a database of such candidates and ensure that he is not recommended to any job in the future......If any legal action can be taken it is the Co which can do that...not the consultant.... But the underlying point is that the consultant cannot ask for money....

Dear Fiaz,
You are not required to pay any amount unless ur into any bond/contract kind of deal with the organization. But do always remember that this is truly unethical on you or rather on any candidate's part if he accepts the offer and then decides not to join the company as one should be aware that it really requires hell lot of effort & cost from the recruiter n the organization to get the candidate on board. I really dont know the reasons for you not joining the org, but going forward plz think twice before you accept any offer. This really helps you from getting into the negative part of the database of the company.

I will support your statement. We put all our efforts to source right candidate and finally put all hopes on that source. And if at all that betray us, ofcourse our tears burst.
I am not blaming consultant people nor the one who accept the offer. This is like bottle neck situation.
From the side of Person who accept offer: Obviously everyone look for better side. That may be the reason he deny other offer.
From the side of consultant people: He completely rely on the candidate joining. If he join he will get reward and bread.
From competition point of view both are correct both are right. One is looking for better side and other want to pull him on his way to get his bread.
From Etiquette point of view both are incorrect.

Hi, Consultant cannot take any action unless you have agreed the conditions on paper............. so dont wory rather you can take action on them.
