Hi all..
I need help regarding my relieving in present company. I joined the company 3 months back and they gave training to me. I didn't like the rules and regulations and i want to go for better offer and good MNC. But the present company HR is not relieving me and telling me that, i need to stay 3 months notice period and i need to pay 3 months salary back.
In offer letter it's mentioned like,
I need to pay 3 months salary and 1 month notice .
But they are telling like i need to pay 3 months and need to stay 3 months. But my new offer will expire in one month.
Please help me regarding the above.

Dear Sriram,
I think in the appointment letter clause thats mentioned above its clearly stated that you should serve the company for three months notice, or if you want to leave it immediately you should give them three months pay.
So i think its better for you to pay them three months notice and take a proper revealing from the current concern to join a good organization.

Actually they want to trouble me and they telling, 3 months notice pay and 3 months stay in company. I already submitted the old pay slips and documents to new company. So, I need to provide the revealing from of the present company. Even offer letter is telling that 3 months pay and 1 month stay, company HR (Head) people not following the things in offer letter.
I am still in confusion with what to do. Can i put any case on those legally with the above offer letter.

Hi Sriram,
Legal case really wont work out because its just waste of time and your money also and the judgment takes hell of time so its better if you tell to the company that you are going to join in that its not possible to submit the revealingly letter and you can show the resignation letter as a proof that you are no more working with that company.

what is "NASSCOM".. HR people are telling, US clients are going to put a case on NASSCOM, by that i wont get job at any where. I am working for the indian company and client is in US. I am not even signed on any documents related to client comapny. Actually client telling he gave 3 months training and that's way they put case. My question is how client can put case on me without signing any thing on his company.

Dear Sriram,
Its not fair enough to leave the company without proper notice. What the company is claiming is exactly right. its not fair enough to violate the norms from your part. rather than going for all such nuisances, its better to request and convince them and serve for couple of days as per mutual understanding and get relieved properly by paying the notice period amount.

Thanks a lot for your reply. Actually I am ready to pay the money. But they are doing these nuisances on me. I am doing the things as per statements in offer leter. But they are not following that and telling about case on "NASSCOM". There is no problem form my side to stay for 1 month as per offer letter. But they are asking for 3 months of stay and 3 months pay. If i do the same, i have to loose the all of my other offers. So, I am still in confusion of what to do.
Please give me reply, as i am doing anything wrong form my side.

Dear Sriram,
As per the clause stated in your offer letter, it has been clearly stated that you have to give 03 months notice and you have agreed with those and signed the same.
FYI : No HR Managers will be harsh until it really impacts the ongoing project. you personally go and request your manager. it mainly depends on your image of attitude that you have projected for last 03 months.
Think smart, act wisely with patience.

Please note before jumping to conclusion or taking any new steps. Kindly discuss the issue with your new employer and take suggestions from them as they are the one who are hiring you. Also ask them if they can hire you without the relieving certificate. You are not a bounded labour as such company cannot take legal action provided you give them sufficient notice in advance say 15 day to 1 month and move on....
