| pbali_99 Started The Discussion: Hi All One of my friends is working for a good company,it has been only 3 months since he joined that company,but now since he is not interested in the job profile,he is going to join a new company.since he is in probation period what will be then notice period.In his offer letter it has been metioned that services can be terminated on either side,without any notice.but he is worried whehter the management accepts his decision or not,and they will ask him to serve notice period.how far is this valid.and can they reject releiving letter to him,or if they dont accept his resignation what can he do. Please do give ur suggestions ,its very urgent
If the Offer/Appointment Letter states that "during probation, termination can be from either sides, without notice", it means he too can put in his papers anytime he feels so. I don't see any problem here. The co. cannot refuse him the relieving letter. However, in all safety, he should first put in his resignation on mail and mark a CC to his personal ID. This way, he will have a copy of the same with him. He can show the same as evidence to his prospective employer which shall act as a document of his relieving duties at his current employment. If 'no notice on either side' is specified in his Appointment Letter, he can resign at any time during his probation period with no obligations on either side. The Company has to issue a relieving letter which it is obligated to do. Ensure that resignation is accepted or you keep proof of having resigned as our colleague has also pointed out. Hi Bali, In probation . employee is not needed to give notice period. Management should relieve hiom in 1 day. But , the resigned employee has to give his handing over charge of his responsibilities to another person officially and then to get relieved. It is always better to follow this process. If it is followed in this manner, the resigned employee will be relieved. to follow this process it takes almost one weeks time. This shows individuals professional behviour. hiii During the probation period, resignation may be accpeted as per company rules and conditions. some company takes 1 month notice period, so notice period depends upon company to company policy. I can suggest, you can cantact to HR deapart in this regard. or u can find resignation and relieving formalities in our comapny policy book. regards basant

Hi all, I read your discussions. But I have a small question on relieving? What are the things to be observed during the Exit clearances otherthan the dues settlement and Is there any law permitting that the relieving paper to be given after 7 days from the day the employee relieves? The situation why I ask this question is, some employee brokes some instruments or repair them at the last working day without our notice. When we come to know, its late as they must have relieved with the relieving papers nicely. So I want to know whether any rule or law permits in giving the relieving papers after 7 days from his last working day? Please help out friends.
