I am working in a small company in Hyderabad.

I kept my resignation on june 4th,2010,as per my offer letter I have to serve 2 months or can go for BUY out.

so my last working would be Aug 3rd.

When ever i ask my manager about my releasing date, he says serve 2 months and leave.

But now they have come up with new clause called "Intent Of Resignation".

because of this new clause i have to serve 15 days more, so my last working day would be Aug 18th.

I planned my career and now everything is getting disturbed of this new clause.

I asked my HR where is that new clause and why it is not mentioned in offer letter?

Intent Of Resignation : Before putting the resignation, Employee has to inform manager formally that in 2 weeks I will resign.

At the time of joining,I signed some documents and i dont have the copy of it.

(Infact I did not get the chance of looking it once, I had to sign the documents with so much pressure from HR).

I asked HR to give me a copy of it, they rejected to give that.

The signed documents are with them only.

Documents are BOND paper.

Do i have to serve 15 days more(Intent Of Resignation)?

As per offer letter its 2 months , is 2 months not enough?

Can I go legally?

They are even threatening that they give me bad conduct.

I am really facing torture because of this.

Please guide me.

any help would be highly appreciated.

Dear Madam,
They can't do anything, stop attending duties after your due date of relieving , have they requested in writing to to delay your relieving by another 15 days , was there any further offer from their side for 15 days extension and subsequent acceptance by you. If this is not the case , then they will not be able to do anything.
As far as bond is concerned , it is illegal in India except it is a training bond . Under Provisions of Bonded labour Act, 1970 nobody can compel you to work.
Hence simply stop attending duties after august 3rd.
Moreover Intention to do something is not legally binding as per Indian Contract Act 1870. They will not be able to do anything.

Dear Sir,
At the time of joining,I signed a document, which specifies the Intent of Resignation. As per this document, I have to serve the company for another 15 days apart from the 2 months specified in my offer letter.
The company has not provided me any copy of this document.
The document is EXECUTIVE BOND PAPER.
Please tell me if on this ground, can the company stop my releaving letter and do I have to extend my service by another 15 days. If not what action can I take?
They are even threatening that they give me bad conduct.

Dear Suman,
Since you have signed the document before joining you had accepted the terms
& conditions of appointment, hence you are suppose to comply with it. The employers have right not to relieve you.
Solution:
Pay you employer for the balance notice period and ask them to relieve you. Some organisation calculate notice period on basic and some other calculate it on Gross pay. Coordinate with HR and seek their help in getting relieved.

I told my HR that I would pay the amount for 15 days but they are not agreeing with me. Any ways thanks for the information. They wants to spoil one’s career. Thanks suman

Now, do nothing write an e-mail to your boss with a copy marked to your boss cc; to HR and to the HR of the new employer stating that i will not be able to serve the additinal notice period of 15 days as such i am suppose to join at the new place. I am willing to compensate 15 days basic/ Gross ( whatever applicable) against balanced notice period, which i will not be serving and stop attending duties.
