I was working with a company in Punjab for 1 year and 8 months. This is a Mumbai-based company. I resigned last February, and in August, I submitted forms for the withdrawal of my PF. However, since that day, I have been regularly in touch with my HR, but she keeps trying to deceive me. I do not know if they have submitted my forms or not. What can I do now because I am feeling very harassed, and I want to teach a lesson to my previous employer and also want my PF in hand.

Please guide me.

Hi,

Please send a complaint to the PF Commissioner in Maharashtra. If you know the number, include the following details in the complaint:

1. Name
2. Your PF number
3. Company's name
4. Address
5. Date of resignation
6. Date of submission of the form
7. Present address

Send a complaint to the Regional PF office in Mumbai. You can find the address online. Additionally, send a copy to the Central PF Commissioner and mark copies to your employer, the Managing Director/Chairman, and the Company Secretary.

Dear Friend,

I sense that you are feeling quite frustrated. Let's address the issue of your withdrawal of PF amount. I hope you have submitted Form 13 for the withdrawal of the PF amount. Kindly inquire with the concerned Regional PF office to confirm the receipt of the PF form. Generally, it takes 45 days for the amount to be credited to your bank account. If not, then resend the PF form via registered post with acknowledgment receipt for proof of service.

After ensuring the submission, you can proceed by addressing a letter to the PF commissioner, enclosing the proof of service, to initiate necessary action. There are provisions under the PF Act that penalize and prosecute violations, so there is no need to worry. Your amount will be in your pocket soon.

To confirm if the company has sent these forms, the organization must have submitted Form 12A to the PF Office. You can inquire at the PF office where your organization is registered.

If these two forms have not been sent, you can obtain Form No. 19 and Form 5-C, complete the details, and have a Gazetted Officer sign and stamp them in place of the organization's or employer's signature. Then, send these forms directly to the PF Office where your organization is registered.

Hi Narinderjit,

Please follow the instructions of Siva. If you have your payslip and your PF number on it, submit this as evidence with your complaint. Also, ask your previous employer for the submission receipt of your PF form, which will help you track your form.

It is true that you can withdraw your PF after 60 days of your resignation. For withdrawal, Form No. 19 and 10C have to be filled out by you, and you need to put your signature along with a revenue stamp and forward it to your employer. The employer will then submit the form along with your 3A to the PF office, and this office will provide an acknowledgment receipt of the same.

You have to ask for that receipt, or you can write a letter to the Director of your previous company stating that you will approach PF authorities if the claim is not settled properly.

Most importantly, don't lose patience; keep positive thinking in your mind.
