Hi Yogesh, I recently joined Wipro, and during the background verification process, they discovered a criminal record associated with me. In 2020, a criminal case was filed against me, but it remains unresolved as the case is still pending. The opposing party involved in the case has been absent from India for an extended period. The company has requested that I provide a non-criminal record or a No Objection Certificate (NOC). I am seeking guidance on how to proceed in this situation. Your assistance would be greatly appreciated.

Dear Yogesh,

I wish you had provided us with a few more facts about the case. Why has the criminal case been filed against you, who has filed it, and how many hearings have taken place? For how many hearings was the petitioner not present? From whom is Wipro asking to bring the NOC?

While joining the company, did Wipro ask you about the criminal case? If yes, did you disclose or withhold the information?

Even if a criminal case has been filed against you, it does not make you guilty. Therefore, your freedom to advance your career cannot be stopped by the employer. Check with Wipro if they are okay with the submission of the affidavit providing the facts of the case. In the affidavit, make a commitment that if the court holds you guilty, you will declare it voluntarily and will give up the employment on your own.
