Maternity Leave Policy in Telangana State
Maternity leaves and other benefits offered in connection with childbirth are governed by a Central Act, namely, the Maternity Benefits Act, and as such, it applies to Telangana as well. The Act provides for 26 weeks of leave with salary for a woman employee. However, it is available to those who have worked for at least 80 days in the 12 months preceding the date of delivery. This means an employee cannot avail of it in the same month of joining.
Other Types of Leave
Now, when it comes to other types of leaves, such as casual leave and sick leave, the law differs. If your establishment is a factory, then leave with wages (privileged leave or earned leave), which is the only leave admissible to the employees in a factory, is available only after 12 months of service. Therefore, it is not available to an employee in the same month of joining.
Conversely, if your establishment is a shop or commercial establishment (any establishment other than a factory, mine, or plantation), the State Act governing commercial establishments will be applicable. In this case, the Telangana Shops and Commercial Establishments Act is relevant. This Act provides for 12 days of casual leave and 12 days of sick leave for every 12 months, which can be availed from the first month of joining. Although an employee is entitled to 12 days of sick leave and 12 days of casual leave, these can be availed proportionately to their length of service. Consequently, an employer can limit casual leave and sick leave to one day each per month. After 12 months of service, every employee will also receive 15 days of earned leave, provided they have worked for at least 240 days in that 12-month period.
