My organization doesn't pay leave encashment. So I have resigned from the organization and need to know whether I can utilize my leave during my notice period. If yes, is there any clause or section mentioned in labor law?

Leave During Notice Period

An employee can take leave during the notice period, provided it is for a genuine reason like maternity, health issues, etc. However, during the notice period, most companies will restrict employees from taking leave as you may need to hand over your tasks or work to the next person who is replacing you. What you can do is take 1–2 days of leave and save whatever leave you have.

During your final settlement, if you have unused leave, say 20–30 days or whatever number of days you have, you will be paid for the same. A maximum of 30 days of PL amount will be paid to the employee. So sometimes not taking leave helps.
