I am in my notice period and need to undergo medical treatment. As it is a medical emergency, I asked my manager for 4 days of leave and informed him that I would also extend my notice period by 4 days. I had already informed him about this leave a month ago, and it was approved. Subsequently, I submitted my resignation. Please let me know if I will be able to take the leave. He is harassing me and threatening not to provide the relieving letter. Please help...

Not sure how your leave policy is defined. Under medical conditions, you may avail yourself of the leave, but there is a fair chance your notice period may get extended if defined in the policy. I suggest you have a discussion with HR and clarify the same. Please have the medical certificate ready to support the leave.

There's something missing in the details you mentioned—don't think you gave the full details. One way to handle the situation is what Srinivas Mummadi suggested. However, you seem to be contradicting yourself—you say it's a medical EMERGENCY and at the same time you mention that your manager has been informed [and also given his OK] about this 1 MONTH AGO. Hope you get the point. Please clarify/confirm the brief details of the medical condition—maybe your manager wasn't convinced about it?

Another way to handle it is: Just wait until you get relieved to get your medical treatment done—saves you the trouble and time of trying to convince everyone.

All the Best.

May it be the case that you have asked for leave when you haven't decided to resign. Resignation does not stop you from taking leave, especially on prior medical grounds. Whatever the case may be, you should be ready to serve those excess four days in your notice period. Your manager is not someone who can stop you from resigning. Don't worry, if your case is genuine and important, please go ahead.

Thank you.

Do not worry; it must be a harassing tactic of the manager and nothing else. Do one thing: finish your notice period, and if they do not provide you with any document, write a letter to them demanding all of the documents and mark a cc to the labor commissioner of your area. You will get the documents with ease. On medical grounds, you can take leaves even during the notice period.
