What is the minimum leave we can give to employees in a startup with an employee strength of 50? Can it be restricted to 1 day per month? We cannot afford to grant leave as per the Shop and Establishment Act considering the nature of work. Is there any temporary arrangement for the leave policy?

For Minimum Leave- you have to prepare Proper Leave Policy. For E.g.- CL-7 , SL - 7 IN A CALENDER YEAR (THIS IS AS PER LAW) An Employee Leave Sanction after completing the Probation Period.

The Leave Policy of an industrial organization should basically conform to the types and scale of leave as provided for in the establishment-specific Labor Law applicable to the establishment. Other aspects like sanction, clubbing of holidays with leave as prefix and suffix, sandwich rule, restrictions on the number of leave that can be taken at a stretch, etc., can be set down in the Leave Policy considering the nature of jobs of the employees.

Your inability to comply with the leave provisions of any law applicable, as reflected in your leave policy, cannot be a valid excuse for non-compliance with the concerned legal provisions.
