Our company name is being changed from Proprietary Concern to Private Limited Company. For the existing employees, is there any need to issue revised appointment letters? Alternatively, can we issue a communication circular to all employees informing them about the change in the company's name, and is it sufficient? Kindly provide me with a reply to meet industrial law requirements.

Since the name/nomenclature of the new entity is coming into existence, please consider issuing fresh letters with a new date without altering employment terms and conditions as any employment is a contract between contracting parties. PF and other details should be in the new establishment's name.

When the Proprietorship Company becomes a Limited Company, normally the transfer of employees and the service continuity to the limited Company, and the continuity of service would be documented by the taken-over Private Limited company in their liability clause. Once this documentation is done, it is better to issue an individual letter intimating the change in management, and indemnification of their service continuity from the previous management to the present management.
