Dear Sir/Madam,

Due to the recession in the industry and an overall downfall in our sector, our company has been paying salaries late or in parts to employees. I send all employees their payslip each month (i.e., pay for the full month). I wanted to know, should I keep sending the payslips each month or not? Are there any legal complications in sending the payslip where the salary isn't paid or paid in parts?

Wage slips must be issued to the employee at least a day prior to the date of wage or salary disbursement, in accordance with the provisions of the Payment of Wages Act, 1936, and the Minimum Wages Act, 1948. What's more crucial is the actual disbursement of wages, rather than just the issuance of the wage slip. The wage slip serves as an authentic document that displays the breakdown of gross wages, deductions made, and the final net amount to be received.

If an employer fails to pay the wages, merely issuing a wage slip becomes a meaningless formality that does not benefit either the employer or the employee. It is essential to ensure timely and accurate wage disbursement to uphold the rights and well-being of the workforce.
