The employee has submitted his resignation, and it has been accepted. However, due to some personal reasons, the employee is taking leaves during his notice period. Additionally, there were a few errors in his work. Although he has provided a written apology, the manager does not find it satisfactory. Can we terminate him on these grounds even though he has only three weeks of the notice period left to serve? Also, should we provide him with a relieving and experience letter?

An employee has submitted their resignation and is currently serving the notice period as per the employment terms. If the employee decides to take leave during the notice period and performance issues are observed, it is advisable to consider relieving them with a short notice period pay included in the full and final settlement, as early relieving is at the discretion of the employer.

Thanks for the reply. However, what about the experience and relieving letter? Should we mention the performance issue in the experience and relieving letter? Will the employee argue that the error had occurred before submitting his resignation and that he should receive a clean experience and relieving letter?

Answer: No. (I immediately corrected him)
An employer can't deny the employee's request for availing leave during the notice period.
