Rahulji,

What do you mean, do they stay in quarters or some dwelling within the factory premises allotted by your company? Do they simply walk into the factory along with the employee and stay put in the workplace? Non-employees are not permitted to stay. If the employee is accompanied by kids, then the kids should be separated and confined to the creche only. If they come with the employee on occasions like festivals or birthdays celebrated in the factory, then it's a different issue. Not as a routine.

Dear Kumar,

Only one employee, along with his family (spouse and children who are above 6 years old), is staying in a separate room on the premises of the factory. Is this arrangement compliant with any labor laws?

Unless it is considered as staff quarters, there is no necessity to accommodate families like this inside the factory premises. If something goes wrong and a family member gets hurt, who is to be held responsible? Did you agree to accommodate them like this when your firm appointed the employee? What if other employees also want to be accommodated like this employee? This is highly irregular. First of all, who allowed them to come in and settle like this? Who provides other necessities like water, lighting, etc.? Who authorized this?

Staying within the factory premises other than for duty purposes is not permitted as per the law. If the Inspector of Factories and Boilers comes to know that an employee, along with his family members, is staying within the factory premises, then he can object to it.
