Hi All,

Can my company terminate/discontinue an employee who is on our agency rolls with immediate effect without giving him any notice period or salary in lieu thereof? It is pertinent to mention here that due to some issues, the agency on which rolls the said employee was, is no longer continuing with our company. However, some of the employees were retained by my company. For the last say 5 months, their salaries are being processed by us.

Kindly guide.

I don't know any reason behind the termination. However, if the terminated person was not on your rolls, then there is no obligation on your company's part to issue any notice of termination. This should be the obligation of that agency.

Arrangement with the agency

What was the arrangement to retain some of the agency's employees with you? Was any retention order given to them by you? If you are not prepared to hire them on your company's rolls, it would be better to engage another agency for this purpose with proper documentation, replacing the separated agency.
