Salary Withholding for Sales Targets

Is it right to mention in an appointment letter that if sales targets are not achieved, the salary will be withheld or not given? Does mentioning this in the appointment letter favor the employer since it is accepted by the employee, or is it invalid since no one has the right to withhold the salary earned by an employee for services rendered? What is the case for salespeople? Is a variable held? The constant has to be given as per attendance, right?

Jurisdiction Clause in Appointment Letters

Another clause mentioned in appointment letters is that if any matter arises, it will be under the jurisdiction of the XXX court. Does this really matter, or is it the free will of the employee to apply anywhere? This concerns jurisdiction regarding a civil court. But if we are going through the labor court, does it apply, subject to conditions?

Salary cannot be withheld. Incentives can be withheld if the target is not met. If a legal dispute arises, the employee will be bound by the agreement, which specifies the jurisdiction. Typically, the company's headquarters will be located at the same place.
