As per law / ID Act whats the minimum & maximum tenure of a wage settlement? In practice we see it ranges from 3-5 years. Clarity required on what law says?

A reference to the Industrial Disputes Act will be informative. The Industrial Disputes Act, 1947, Section 19 deals with the period of operation of settlements and awards.

(1) A settlement shall come into operation on such date as agreed upon by the parties to the dispute. If no date is agreed upon, it will be the date on which the memorandum of the settlement is signed by the parties.

(2) The settlement will be binding for the agreed period. If no period is specified, it will be binding for six months from the date of signing the memorandum. It will continue to be binding until two months after one party provides written notice of intention to terminate the settlement to the other party/parties.

(3) An award shall remain in operation for one year from the date it becomes enforceable under section 17A. However, the appropriate government may reduce or extend this period, ensuring the total operation period does not exceed three years from the date it came into effect.
