Hi, one of my colleagues worked for a company in Kolkata for 7 years and 2 months, and the company is now unwilling to pay her gratuity. She has been following up in the last month, but the finance team has been dragging things and finally said, "Our company is a loss-making company, and we cannot pay the gratuity amount." She wants to complain to the labor department to withdraw her PF as well as the gratuity amount. Can anyone please guide me through the entire process to complain in the labor department to claim PF and gratuity so that I can help her?

Please fill up Form I under the West Bengal Gratuity Rules and send it to the organization. If payment is not received within 30 days, the claimant employee can submit an application within 90 days in Form N in triplicate to the Local Labour Officer duly supported by documents showing the date of joining service, the date of leaving service, and the last pay drawn. You will get gratuity with interest.
