Retirement and Employment Details

I retired as a Government Medical College faculty at the age of 55 years, which is the retirement age in Kerala Government service. I then joined a Private Medical College as a Professor on a regular basis with a consolidated salary. I retired after 15 and a half years of service. During the last three years of service, the payment was on a regular scale and not consolidated.

Salary and Provident Fund Details

The salary disbursal for part of my service was titled 'Professional fee' with IT deduction at 10% of the total emoluments disbursed as a Professional fee. I did not make any PF contribution during the period of employment for 15 and a half years in the establishment. The establishment is governed by the EPF scheme for other employees. I had drawn Gratuity of 2.5 lakhs on retirement from Government service in 2002. There was no contributory Provident Fund Scheme in Government service during my tenure of service, only employees' contributions which were disbursed at the time of retirement.

Eligibility for Gratuity

Kindly clarify whether I am eligible for gratuity as my duration of service in the establishment is more than 5 years.

How many years in Pvt service did you draw a salary? You are entitled to gratuity from Pvt service.

Discreetly consult the area labor commissioner or an advocate specializing in labor law. What does your employer say about gratuity?
