Case 1: Government Employee Retirement

A government employee, after his retirement, joined our company with a salary of Rs. 30,000 per month. He is eligible for PF and pension deductions.

Case 2: Private Company Retirement

A person, after retiring from a private limited company at the age of 60, following 10 years of continuous service, joined another company. He is eligible for PF contributions from the new company, having already withdrawn his PF from the previous company and receiving a pension from the government.

Please provide suggestions for the above two cases.

(a) A government servant who is drawing a pension and working in a private company, drawing a salary of Rs. 30,000 per month - is he eligible for PF deduction? If this is what you are trying to ask, then it depends on the private company and the category of employment given to him. I have a friend who joined a private company after serving in the government for 30 years and is now drawing a salary of Rs. 30,000 per month. He has been employed as a retainer, meaning 'On Contract'. He is not considered for deduction for any funds but is given a lump sum amount and asked to choose any course he wishes to. Some companies provide other facilities and extend all the benefits given to other employees, provided the retired government servant is below 58 years of age.

Since the first person is retired from government service, he has never been a member of EPF. If his salary is now above Rs 6,500 per month, he need not be covered under EPF. The second person is also an excluded employee and need not be covered.

Hope that you have not understood what seniors have advised. It clearly states that if the government employee who is retired and is drawing a pension is not eligible for PF contribution at all. In a nutshell, they are not covered under PF.
