Can you please help us out with information on one statutory requirement? Is ESI applicable to the staff working under the category of Old Age Homes in Karnataka? Your response will be highly appreciated.

1. Sir, Old Age Homes, if charging for accommodation and receiving fees, etc., will, in my opinion, qualify to be considered as a "shop," and hence can be covered under the ESI Act, 1948, and the rules/regulations framed thereunder. A notification issued by the State Government of Karnataka under section 1(5) of the said Act can also be referred to (which is generally available on the website of the Regional Office, etc., of ESIC).

2. It would be better if you contacted the appropriate officer at the ESI Regional/Sub-Regional Office of ESIC, submitted complete facts of the establishment in which you are working, for their decision on whether the same qualifies for coverage under the said Act.

How many employees are working in the old age home? In my opinion ESIC scheme should be applicable to employees of the old age home.
