Gratuity and Provident Fund are two separate things.

Gratuity

An employee is eligible for gratuity only if they complete a period of continuous service for 5 years in the same organization. Gratuity is also known as a "Loyalty Bonus." It has nothing to do with whether PF is being deducted or not. If you complete a tenure of 5 years of continuous service in the same organization, then you are eligible for gratuity as per the Payment of Gratuity Act 1972.

Hope this resolves your query.

You need to share more facts and figures and correct details about the nature of your employment and the organizations you work with. Gratuity and PF are two entirely different regulations. The good news for you to share is that PF and Gratuity fall under separate Acts. Both benefits are social obligations and are compulsory, but can be legally addressed if you provide details such as your salary, the number of employees in your company, and your date of joining, etc.
