I am an HR Executive working in a private firm for the past one and a half years. I am currently on the notice period in this company as I will be joining a new company in a few days. I am serving an 11-day notice period in this company while the company is asking for a one-month notice period.
I am still on probation in this company as I have not received a confirmation letter. When I completed six months, I was provided with an extension letter for my probation period of three months, but after three months, no letter was provided for the same. The company is stating that as I have received one increment, I am liable to give a one-month notice period. However, when I reviewed the appointment letter, it clearly states as follows:
"You shall be on probation for a period of six months which is liable to be extended by a further period of six months. Unless communication is received by you after completion of six months confirming your permanent absorption, your probation period would be deemed to have been automatically extended. However, management reserves the right to reduce the probation period at any time solely at its discretion."
"That on your satisfactory completion of the probationary period of employment, your case for permanent absorption in the employment of the company shall be considered. You shall, therefore, have no legal rights to continue in the employment on expiry of your probationary period of employment unless it has been confirmed in writing."
"That your appointment shall be subject to termination on either side by giving one month's notice in writing or payment of salary in lieu thereof after confirmation of your services in the company. In the event of your resignation, the management may accept the same with immediate effect and waive the notice period in which no dues shall be payable to you after your last working days. Only a 15-day notice will be required for terminating the contract during the period of probation."
