Hi, I have joined a company on 4th July on a probation period of 3 months. After the probation period ended, and despite no confirmation communication in writing, I want to leave the company. During the probation period, the notice period was 45 days, which increases to 2 months upon confirmation. The employer requested a 2-month notice period, which I did not accept. Consequently, I did not go to work for 3 days, and they sent me a legal notice from a lawyer to either serve the 2-month notice period or pay 2 months' salary.

Please help me understand what conditions apply to me.

Your stance on a 45-day notice period due to the non-receipt of a confirmation letter is acceptable. However, why didn't you go to the office? Your employer may take advantage of this situation and portray it as unauthorized absence without information once you submit your resignation. It would be best to resolve this amicably with your employer. While the legal aspect is a separate matter, please try not to hinder the separation process with your employer.

Notice period has to be at par with the agreement that has been signed between you and your employer. However, as suggested above by the learned member, it is wise to resolve the issue amicably and not to get into direct confrontation with the employer. Keep in mind that litigation can go on for years and years – can you afford it?

Did your appointment letter state that services are confirmed upon completion of a 3-month probation period, or will your service confirmation be provided in writing upon successful completion of the probation period? There are two conditions mentioned: one is automatic confirmation, while the other requires written notification for confirmation.
