Seeking Advice on Addressing Unethical Practices

I need your sincere advice to stop unethical practices in my company and also inform the concerned government department for necessary action. I'm working as a Manager in an MNC Surgical Company in Kolkata. Our main warehouse is in Gurgaon, and we sell the products through our authorized distributor in Kolkata. Fourteen people report to me, and we have a Logistics Manager (under direct payroll) based at the Kolkata office.

Issues with Office Registration and Tax Compliance

Currently, our Kolkata office is not registered under the Shop and Establishment Act of West Bengal. Our office is located in a residential complex and has not paid Kolkata Municipal Tax for maintaining the office. Additionally, our Branch Executive and Office Boy are under third-party payroll.

Concerns with Commercial Tax Practices

Several times, the Commercial Tax inspector has raided our office and settled with freebies in terms of cash and gifts. To bring a Demo Machine to West Bengal, they transfer the tax amount to my salary account and direct me to pay sales tax in my name. They have declared me as an unregistered trader to take advantage of generating a Waybill to bring the Demo Machine. I have suggested a legal way by depositing the tax amount as a bank guarantee to the Sales Tax Commission, but they avoid this legal route and continue the illegal process.

Misrepresentation in Import-Export License

In the Import-Export License, they declare that they have offices/branches in Kolkata with the same local address, but in reality, they are not maintaining the official protocol of registering it.

Please help me resolve this matter and protect my employment.

First of all, you must register your establishment under the Shops and Establishment Act of West Bengal. You can approach a compliance agency that can assist you in this matter. Once you register your establishment under the S&E Act, you will begin following all the necessary regulations and can run your business peacefully.

Thank you for your suggestion, but somehow my company doesn't want to register. It's INCORPORATED since 2001, but to date, they have never tried to register despite reminders and requests. Now I'm feeling suffocated, so I want to leave. But before that, I want to alert them to the consequences of not registering themselves. I've informed this to my HR Head and MD, but in vain.

Consequences of Not Registering

Please elaborate on what the consequences are if it's not registered so that I can explain the same.
