Once the Payment of Gratuity Act becomes applicable to the establishment, it is the responsibility of the employer to send a "Notice of Opening" in Form A to the appropriate authority within 30 days. In case you are looking for any professional support, please write to us.

In case of an establishment, if the Payment of Gratuity Act is applicable, you are required to send a "Notice of Opening" in Form A to the concerned labor department falling under your jurisdiction, within 30 days. Besides, you are to maintain a Gratuity Register and also ensure that the "Abstract of Gratuity Act & Rules" is displayed on the notice board of your establishment.

Can anyone let me know the solution for the following situation? The employer registered under the provisions of gratuity in 2008 (for example) but has had employees since 2003. Kindly let me know, will the gratuity calculation be based on the year of registering into gratuity or from the date of appointment of the employee?
