In our central government organization, one employee was transferred to another department effective from 18.02.2013, and he has not reported to duty till date. We have paid his salary up to the month of February 2013. Since March 2013, we have not paid his salary, and subsequently, we have initiated an inquiry commission for this matter. The inquiry officer has recommended giving him compulsory retirement effective from 20.11.2013.

Inquiry and Disciplinary Actions Under CCS (Conduct) Rules
The question arises whether any departmental inquiry has been conducted under CCS (Conduct) Rules, if applicable to your organization? Or whether any departmental inquiry was conducted after the issuance of a show cause notice to an employee under service rules as applicable in your organization? If so, whether the report of the Inquiry Officer has been accepted by the Disciplinary Authority and what the orders of the Disciplinary Authority are.
Consideration of Past Service and Leave Encashment
Whether the past service has been forfeited or not is also an important aspect in relation to the question of encashment of the balance earned leaves.
