I have been working in a company in Saudi Arabia as an Admin since November 2012. Before coming here, I was informed that I would have a yearly vacation and could leave the company at any time after completing the 4-month probation period. I requested a vacation in October 2013, but it was rejected, stating that I could not take a vacation for 2 years. Despite many requests, they still did not approve it. Subsequently, I asked for an exit, and they informed me that I cannot leave until the contract is completed. According to the contract, the duration is 40 months with a 4-month probation and a 36-month contract. It is mentioned in the contract that we can pay 90% of the visa fee if an exit is required during the contract period. I am seeking information on the visa fee and guidance on what to do if they refuse to grant me an exit. My visa falls under the labor category.

The reason I wish to leave the company is that I was brought here for an Admin role, but the company has assigned me a marketing job for the past 10 months. My request for a vacation was also denied.

I would appreciate your suggestions on the best course of action to exit the company.

First of all, I would like to say it is wrong on the company's part to ask the employee to work on something that has not been there in the contract. Having said that, I would like to mention, if your contract clearly states that you can exit by paying 90% of the Visa Cost and if you are ready to pay that amount, I guess there should not be a problem. You should discuss with the higher authorities of the company, explaining clearly the reasons for the exit. Do mention that you were asked for admin duties during the appointment period and now you are being asked to do a marketing job. I hope that they will understand and clear the matter.

I appreciate that you took concern in my problem. But my higher management itself is denying my exit and are asking for a very high cost in which we can buy 2 visas.

Immediately inform the Indian embassy. You will be released forthwith. The Indian Embassy in the Middle Eastern countries is very supportive to Indian nationals, and they will take it up with the employers through the Manpower Ministry. You will be sent off gracefully after complying with all the terms of the contract.
