Hello,

My name is Vaibhav. I am resigning from my company without any notice and without any handover. I am writing a formal email to the CFO of the company for resigning. If they issue any legal notice, what should I do? Please help me with this.

Please elaborate on your query. First, you are supposed to send a resignation to your HR/Reporting Manager. If the employer takes legal action against you, then seniors can advise you only after receiving the claim/input of the notice. At present, you are just assuming things.

It is advisable to provide a proper handover with the notice period as mentioned in the Appointment letter. Always consider how you would feel if the employer terminated you without any notice or salary. The employer would feel the same way. The rest is your choice on how to deal with your query.

Last but not least, this forum is to advise people in need when they are in trouble, not to assist in wrongdoing. It is advisable to hire legal experts for such matters.

Vaibhav,

It shows how loyal you are to your organization if you want to abscond without proper handover/serving notice period, and your company has every right to slap a legal notice on you.

If I were your employer, then I would have at least posted an ad in the newspaper claiming that you are absconding from my company and some of the confidential data and information are missing. None of your prospective employers would even dare to hire you with this kind of background.

Please ensure you do proper handover, get relieved on good terms, else you may never get a job with good employers - your background check report will be RED if you are not properly relieved from your previous employer.

It is not right to quit employment without observing the agreed conditions in appointment order, without handing over, and asking for help. It is always advisable to leave an organization on a cordial note. The company can:

1. Hold/delay your PF settlement,
2. Inform your new company about your actions,
3. Refuse your balance salary,
4. Deny you a service certificate.
